An employer has the right to conduct a New Jersey criminal background check for applicants and employees as long as they are done with respect to the law. In accordance with §34:6B-11-19, employers with 15 or more employees are not permitted to inquire into an applicant’s criminal history until after the first interview. Furthermore, any criminal history which has been expunged or pardoned cannot be considered as a basis of judgement of character. Employers must also give their employees enough notice of any actionable findings so that they may have the opportunity to contest the accuracy of the report (§13:59-1-2). In addition to these restrictions, employers must also ensure that their use of background checks is in no way discriminatory, defamatory, or a breach of privacy.

Cost –  $40.69 for requests by form, $20 for online requests by name

Online Criminal History Record Request by Name

Employers can conduct an online criminal background check by name, for a fee of $20, on the New Jersey State Police’s (NJSP) website.

Step 1 – Navigate to the NJSP Website

Click here to navigate to the NJSP Website.

Step 2 – Begin a Criminal Background Check

Click Online 212B Form to begin a criminal background check.

Step 3 – Provide Purpose of Request

Select For determining a person’s qualification for employment.

Step 4 – Provide Requestor Details

Enter the following information into the indicated fields before clicking Continue:

  • Full name
  • Email address
  • Phone number
  • Full address

Step 5 – Provide Subject Information

Next, you will need to provide the following information in regards to the subject of your search:

  • Full name
  • Sex
  • Race
  • Date of birth
  • SBI number
  • FBI number
  • SSN

Step 6 – Provide Subject’s Email

Now enter the subject’s email into the two indicated spaces.

Step 7 – Provide Subject’s Address

Supply the subject’s complete address before clicking Continue to proceed.

Step 8 – Review Information

Look over all over the information that you have supplied and click Edit, where appropriate, if you need to make any corrections.

Step 9 – Select Payer

Select who will be paying for this service before clicking the Continue button.

Step 10 – Agree to Attestation

At this juncture, you will need to agree to all of the conditions listed in the “Attestation” box in order to continue. If you agree, check the checkbox that indicates this is the case and enter your name into the indicated field. When you are ready, click Continue to continue to the payment page.

Step 11 – Complete Payment and Perform Search

By following the instructions in the steps that follow, once you complete your payment, your search will be performed.

Employment Criminal History Request

In order to conduct an employee criminal history check by fingerprint, the employer will need to get the employee to complete the New Jersey Universal Fingerprint Form D and schedule a fingerprint appointment (tel: 1-877-503-5981).

Step 1 – Fill Out the Form

The employee will need to provide the information listed below into the indicated fields:

  • Full name
  • Daytime phone number
  • SSN
  • Date of birth
  • Height and weight
  • Maiden or alias name
  • Place of birth
  • Country of citizenship
  • Home address

Step 2 – Finish Filling Out the Form

Next, they will have to supply the following additional information:

  • Gender
  • Hair and eye color
  • Race
  • Occupation
  • Employer
  • Employer address (the criminal history report will be sent to this address)

Step 3 – Present Form at Fingerprint Appointment

The employee will need to present themselves at the fingerprint appointment with the completed form and pay the $20 fee (credit/debit). Once the employee’s fingerprint’s have been taken, they will be given a receipt and PCN number. Results of this background check will be sent to the employer.
