Employers in Nebraska are permitted to perform criminal background checks on their employees and potential hires. However, in accordance with the Ban the Box law (§48-202), public sector employers are not allowed to ask any questions about an individual’s criminal history until such a time that the applicant is being considered for a position. The Nebraska State Patrol (NSP) maintains a public record of all convicted felons residing in Nebraska which can be accessed online. Employers can either use this online resource in order to conduct a criminal history search or they can submit a criminal history request to the NSP by mail.
