Illinois gun background checks are performed on individuals applying for an FOID (Firearm Owner’s Identification) card. The State recently updated their firearms laws to make the buying/purchasing process more restrictive, in an attempt to decrease gun violence. All individuals wishing to purchase a firearm from a private seller must have a valid FOID card. In order to obtain an FOID card, an application form must be completed and a background check will be conducted by Illinois State Police (ISP). Under Illinois law, FOID card applicants must be twenty-one (21) years of age or older, or they must provide written consent from a parent or guardian.

Bill of Sale – Can be used to record a firearm purchase between buyer and seller.

Prohibited From Purchasing – Persons unable to obtain an FOID card, thus unable to purchase a firearm, are mentioned under Illinois Statute 430-65-8.

For Sale of a Gun

Step 1 – The first step to acquiring a firearm in Illinois is to apply for an FOID card. Those who already have an FOID card can proceed to “Step 7”. Those who don’t can navigate to the ISP Firearms Services Bureau website and click Enter under “FOID Card”.

Step 2 – New users can click the Register Now link. Returning users can enter their user ID, password, last name, and date of birth to sign in, and proceed to “Step 6”.

Step 3 – The first step of the user registration process includes providing the following information into the appropriate fields:

  • Last name
  • Date of birth
  • User ID
  • Email address
  • Password
  • Four (4) security questions and answers

Step 4 – At this juncture, enter the following information:

  • Full name
  • Previous names (aliases/maiden names)
  • Date of birth
  • Eye color
  • Phone number
  • Driver’s license or State Identification

Step 5 – The last step of the registration process requires an electronic signature.

Step 6 – Once an account has been made, users can apply for an FOID card. The following requirements must be met before applying:

  • Valid electronic photograph taken within last thirty (30) days
  • $10 fee payable by credit card or electronic check

Applicants’ criminal history will be investigated by the ISP through a background check using their criminal history record information files through the FBI, the NICS, and the Department of Human Services. This is to ensure the applicant is not convicted of any felonies and does not have a history of mental illness or institutionalization.

Step 7 – With a valid FOID card, individuals can purchase firearms from private dealers. It’s the responsibility of the dealer to sell firearms only to those who present an FOID card. The seller will call the ISP or look up the purchaser’s FOID card number online on the ISP website.

Step 8 – The seller of the firearm must keep record of the sale for 10 years – containing date of transfer, gun information, purchaser/trasfeeree FOID card number.

Concealed Carry License (CCL)

To apply for a CCL, applicants must be twenty-one (21) years of age and carry a valid FOID card. Sixteen (16) hours of concealed carry firearms training is required prior to application. Other requirements include a valid identification card, proof of past ten (10) years of State residency, applicant’s fingerprints, and $150.

Step 1 – Access ISP Firearms Services Bureau website and click the Enter button within the CCL section.

Step 2 – Users can sign in using their login credentials. New users will have to click Register Now to create an account.

Step 3 – Enter the following information to create an account:

  • Last name
  • Date of birth
  • User ID
  • Email address
  • Password
  • Four (4) security questions and answers

Step 4 – Next, the following information must be provided:

  • Full name
  • Previous names (aliases/maiden names)
  • Date of birth
  • Eye color
  • Phone number
  • Driver’s license or State Identification

The last step will have users submitting an electronic signature.

Step 5 – Once an account has been created, users can complete and submit the CCL application form along with a copy of their training certificate. A background check will not be performed since the ISP conducted one during the FOID application process.
