Florida criminal background checks can be requested by any employer and criminal records can be accessed by the general public. Only qualified agencies (i.e. government) and organizations (VECHS program) can perform an FBI criminal background check. A criminal background check can be conducted online or by mail through the Florida Department of Law Enforcement (FDLE).
Cost – $24
Laws – Title XXXI, § 435.(01-12)
Step 1 – Background Check Authorization Form
Criminal records are open to the public in Florida; therefore, a background check authorization form is not required. However, under the Fair Credit Reporting Act (FCRA), a criminal background check would be included in a consumer report and therefore employees must give consent to an employer before they perform a criminal background check. A background check authorization form can be used to provide consent.
